Web Censorship Bill Sails Through Senate Committee

COICA would allow the federal government to censor the internet without due process.

Because it is so ill-conceived and poorly written, the law professors wrote, “the Act, if enacted into law, will not survive judicial scrutiny, and will, therefore, never be used to address the problem (online copyright and trademark infringement) that it is designed to address. Its significance, therefore, is entirely symbolic — and the symbolism it presents is ugly and insidious. For the first time, the United States would be requiring Internet Service Providers to block speech because of its content.”
Scholars, lawyers, technologists, human rights groups and public interest groups have denounced the bill. Forty-nine prominent law professorscalled it “dangerous.” (pdf.) The American Civil Liberties Union and Human Rights Watch warned the bill could have “grave repercussions for global human rights.” (pdf.) Several dozen of the most prominent internet engineers in the country — many of whom were instrumental in the creation of the internet — said the bill will “create an environment of tremendous fear and uncertainty for technological innovation.” (pdf.) Several prominent conservative bloggers, including representatives from RedState.com, HotAir.com, The Next Right and Publius Forum, issued a call to help stop this “serious threat to the Internet.”

How Come Members of Congress Investments Made Money?

Stock holdings are among the assets covered in the report, and the investing tastes of Congress appear to be somewhat conventional, with large-cap, Dow 30 members dominating the widely-held list.

General Electric [GE 15.87 0.01 (+0.06%) ] , parent company of CNBC, is No. 1, with 82 current members of Congress listing it. Rounding out the top five are:Bank of America [BAC 11.729 -0.211 (-1.77%) ] (63), Cisco Systems [CSCO 19.58 0.145 (+0.75%) ](61), Proctor & Gamble [PG 63.415 -0.035 (-0.06%) ](61) and Microsoft [MSFT 25.745 -0.065 (-0.25%) ](54).

In another context, however, Beltway watchers might find it unsettling that some of the most widely-held stocks are those of companies at the center of the financial crisis in 2008-2009.


In addition to Bank of America, Goldman Sachs [GS 165.53 0.43 (+0.26%) ] , Wells Fargo[WFC 26.91 -0.28 (-1.03%) ] , JPMorgan Chase [JPM 39.19 -0.42 (-1.06%) ] and Citigroup[C 4.185 -0.035 (-0.83%) ] were popular holdings. All of them received funding under the TARP. Morgan Stanley, General Motorsand AIG are not on the list.

Another big sector is health care-drugs, which, like financial services, was the subject of major reform legislation in 2009.

Look Who's Making Money from the TSA Scanners

George Soros and Michael Chertoff are profiting off controversial new TSA scanner


Be sure and read Tim Carney’s Examiner column today on the politically-connected lobby for the controversial new TSA scanners that are upsetting airline employees and travelers everywhere. Carney notes that a company called Rapiscan got a $165 million contract for the new body image scanners four days after the underwear-bomber incident this past Christmas. Not surprisingly, Rapiscan is politically connected, observes Carney:

Rapiscan got the other naked-scanner contract from the TSA, worth $173 million. Rapiscan’s lobbyists include Susan Carr, a former senior legislative aide to Rep. David Price, D-N.C., chairman of the Homeland Security Subcommittee. When Defense Daily reported on Price’s appropriations bill last winter, the publication noted “Price likes the budget for its emphasis on filling gaps in aviation security, in particular the whole body imaging systems.”

Then this morning Carney also noted that former Homeland Security secretary Michael Chertoff was flacking for Rapiscan.

As for the company’s other political connections, it also appears that none other than George Soros, the billionaire funder of the country’s liberal political infrastructure, owns 11,300 shares of OSI Systems Inc., the company that owns Rapiscan. Not surprisingly, OSI’s stock has appreciated considerably over the course of the year. Soros certainly is a savvy investor.

If President Obama is smart, he will try to salvage his term in the White House by announcing now that he will not undertake a hopeless campaign for reelection, and instead form a bipartisan national unity government to try to hold the nation together until his successor, inevitably a Republican, is selected in November 2012.


Historically, incumbent presidents who have sought another term have won them by a two-to-one margin. Those aren’t impressive odds. How many of us would bet on a horse with minimal chances like that? Since 1900 only one incumbent president whose party captured the White House from the other party four years earlier (Jimmy Carter) has been beaten. The other incumbent losers—Taft, Hoover, Ford, and the senior Bush—were from a party that had held the White House for two or more consecutive terms. But the key is that Carter and Obama are practically twins; both won the Nobel Peace Prize. Enough said. Moreover, the present moment is unprecedentedly perilous for an incumbent president. There’s really no comparison in the existence of the American Republic, save for about a dozen crises like the Civil War, economic panics, the Great Depression, world wars, and 9/11.


Democrats may also place false hope in the fact that the next presidential election will have a turnout twenty full percentage points higher than we saw in the midterm—probably about 40 million more people than voted on Nov. 2. No doubt these “midterm-missing” voters are disproportionately 18-34 years old and members of minority groups, segments of the population that backed President Obama by margins ranging from 62% to 95% in 2008. Obama can’t seem to get them to cast a ballot except when he’s on the ballot. Well, yes, he’ll be on the ballot in 2012, but they’re likely disillusioned with him, too.

This hypocrite thinks he is going to fool Virginians by pretending he's a blue dog democrat. Virginian's aren't stupid, and for those who are gullible, there are plenty of us who will remind them of Warners votes for Obamacare, Tarp and other dangerous bills that Obama Reid and Pelosi sent through the Senate.

Thanks to New York , California and democrats, we're in for a heck of a time. From what I've heard there is already a movement under way to stop the Feds from bailing out both states. Those people voted for the mess they're in, let them pay the consequences...

Indebted and Unrepentant
New York and California stand virtually alone against the rest of the country.

This sets up what could be an ugly fight in which a Tea Party–inflected national Republican Party, encouraged by its strength in the interior states, forces California and New York—now heavily dependent on federal subsidies—to reduce their spending sharply. The coastal giants would no doubt respond by threatening defaults, which could affect the credit standing of the entire country, since many of the bonds are held by foreign investors. The upshot would likely be a high-stakes conflict about free trade, globalization, social class, race, illegal immigration, and public-sector unionism.




Another District 11 Update

1. No winner has been declared in the 11th Congressional District Election, which remains one of the closest elections in the country. Three days after the closing of the polls, the difference in votes for Keith Fimian and Gerald Connolly is less than 1,000 votes out of over 220,000 cast in the election -- well within the margin for a recount in Virginia.

2. Right now, each locality in the 11th Congressional District is winding up a post-election canvass, including counting provisional ballots. The canvass is a legal process in which local officials literally reconstruct the results of the election one voting machine and one precinct at a time, to ensure that all votes validly cast in the election are counted fairly and accurately. Once the local canvass is finished, including provisional ballots, the local officials will send the election returns to Richmond for further review by state election officials, who will certify the official results of the election later this month.

3. The canvass is a public process, and our observers have been monitoring it since the minute it began.

4. There are several developments in the Fimian - Connolly race that may call into question the accuracy of the current vote totals.

Here are the issues that are being looked at:

  • In Fairfax County, the voting machines failed to register votes from over 800 ballots, including 106 in the Sideburn precinct alone. (Keith Fimian won that precinct 58% - 40%.) In Prince William County, the machines failed to register votes on more than 200 additional ballots.
  • In several precincts, there were actually more votes than voters. That is, voting machines reported a higher number of votes than the number of voters marked on the pollbooks as having voted in the election.
  • As of Election Day, there were over 1,150 absentee ballots that had been mailed out to military and other overseas voters but had yet to be received back in the 11th Congressional District.
  • We also understand that officials in Prince William County rejected over 280 absentee ballots, with another 200-300 absentee ballots being rejected in Fairfax County.

So the process is unfolding as set forth in the law and these are some of the questions that are being considered at this time.

Tea Party Movement No Longer Funny

"We the people" did it and they're not laughing anymore! I think they finally HEARD US But are they Listening?

"the Tea Party movement - have in less than two years not merely changed American politics, but reversed its direction entirely.

Tuesday's results make clear the Tea Party is the most dynamic and successful grass-roots political movement since Thomas Jefferson and James Madison organized the Democratic-Republican revolt against John Adams and the Federalists in 1800.

They did so because they did exactly what they should have done. Instead of fighting specific issues and causes like Card Check and cap-and-trade, they ignored their critics while focusing their energies on finding, fielding, funding and fueling candidates for elected office at every level of government, but especially for Congress.

They worked within the system in the most direct way possible by defining the decisive issues of the 2010 campaign and putting forth candidates to replace Washington officials who refused to listen to the people during the long, hot summer of Town Hall protests in 2009.

Tea Partiers should prepare for a Long March rather than a quick fix. As Ronald Reagan put it, we didn't get into this mess overnight and we won't get out of it overnight either.

That means finding another great crop of congressional candidates for 2012 and 2014. It also means the presidential race should NOT be a Tea Party priority. Presidents stand on the bridge barking commands, to be sure, but we can thank the Founders for putting Congress in charge of the rudder.

There is, after all, a reason the Constitution makes Congress the first branch.

VA 11 UPDATE

From the Fimian Campaign

As you know, we are locked in one of the closest congressional elections in the country. The unofficial election night returns showed a razor-thin difference of about 400 votes between the candidates out of over 220,000 cast. Today we have been working through the post-election canvass process in which local elections officials scrub and double-check the unofficial election night totals, review provisional ballots, and send their results to Richmond for certification by state officials later this month. At this minute, we still do not know what those results will be.
The post-election process is first and foremost a legal process which aims to ensure that all ballots lawfully cast in the election are counted, and that the resulting votes are tabulated accurately. This process has required us to hire an experienced election lawyer and continue paying staff to engage a strike force of several dozen volunteers who are vigilantly monitoring the process for us.

Keith has been very grateful for your support of his message of creating jobs and reducing spending, but now we need to turn to you again and ask for an urgent on-line contribution to pay campaign expenses to support our post-election efforts and bring home a hard-fought victory.

Virginia District 11 Results in Limbo...

In the still-undecided congressional race between incumbent Democrat Gerald Connolly and Republican challenger Keith Fimian, both sides on Wednesday claimed they would ultimately prevail in a contest that could come down to a recount.

countered a problem at the polls, were still being counted Wednesday and precinct totals were being double-checked. But the Connolly campaign claimed the math was on their side and Connolly delivered what amounted to a victory speech late Tuesday, even though Fimian has not yet conceded the race.


Depending on what vote tallies reveal, a recount is a distinct possibility. There are no automatic recounts in the state. The losing candidate can request one after the election results are certified if the margin is 1 percent or less of the total votes cast in the race.

But Tim Edson, Fimian's campaign manager, stressed that their focus on Wednesday was simply on getting the outstanding votes counted.


"We're optimistic that when all the votes are counted that Keith will be the next congressman for the 11th District," he said.


The board of elections will meet to certify the election results on Nov. 22. Fimian would have until Dec. 2

The Alabama Legislature is Republican for the first time since 1876.

For those saying this is nothing because it is the South, consider these:

The entire Wisconsin and New Hampshire legislatures have flipped to the GOP by wide margins.

The State Houses in Indiana, Pennsylvania, Michigan, Ohio, Iowa, Montana, and Colorado flipped to the GOP.

The Maine and Minnesota Senates flipped to the GOP.

The Texas and Tennessee Houses went from virtually tied to massive Republican gains. The gains in Texas were so big that the Republicans no longer need the Democrats to get state constitutional amendments out of the state legislature.

These gains go all the way down to the municipal level across the nation. That did not happen even in 1994.


Voting Machines "Malfunctioned" in Fairfax

I got this email late last night....
Team Fairfax-

Here is a quick update on the race in the 11th Congressional District. Currently Keith Fimian sits 487 votes down in the total count. There are currently two machines in two different precincts in Fairfax County that malfuncioned. They are sealed and are locked up in the Fairfax County Government Center.

Those machines will be broken open and counted at 8AM and once that process is completed and verified, we will then proceed to the 9AM canvass. Once the canvass is complete, and the count becomes official, we will then determine what the next steps are per a recount.

Stay tuned, we will have an update as soon as possible.

Before an Americans for Prosperity event in Charlottesville, VA , a supporter of Democratic Rep. Tom Perriello stopped his car, went on a screaming tirade, ripped up yard signs, threw them, and called the people in attendance ‘racists’- to put it lightly.
A couple of minutes later, another man comes up to the group and also calls them ‘racists’ and ‘bigots’. Both are clearly beyond heated as the people filming the video remain calm.
